By downloading, installing, or using Pictal , you agree to be bound by the terms and conditions of this User Agreement . This Agreement constitutes a binding agreement between You and Pictal governing Your use of the App, including all features, services, and content provided through the App. If You do not agree to all the terms of this Agreement, You must not download, install, or use the App. Your continued use of the App after any modifications to this Agreement shall constitute Your acceptance of the modified terms.
Pictal is an AI-powered photo creation app designed for a clean workflow that combines visual generation and caption writing. The App allows You to start with Your own photo, describe what You want to change, generate a new photoreal result, then refine a short English caption that matches the final image. The App focuses on practical creation rather than complex editing panels, enabling You to move from idea to shareable output quickly. The core flow includes: selecting a photo from Your device’s library or taking a new photo with the camera, writing a creative direction in Your own words, generating a photorealistic result with a realistic camera look, editing the suggested caption (if desired), and publishing the result to Your personal Record. The App supports local storage of published results, cache clearing, and in-app access to the Privacy Policy and this User Agreement. The App uses only Pictal’s self-developed AI services and never uses any third-party AI services, data processors, external tools, or third-party APIs . All AI technology powering the App is independently developed and maintained by the Company, ensuring complete control over data processing and privacy protection.
You represent and warrant that You are at least 18 years of age or older . The App is strictly intended for use by individuals who are 18 years of age or older. By using the App, You confirm that You meet this age requirement and that all interactions with the App will be responsible and appropriate. The Company does not knowingly allow Users under the age of 18 to download, install, or use the App. If the Company becomes aware that a User is under 18 years of age, the Company reserves the right to restrict or terminate that User’s access to the App immediately without prior notice, to ensure the protection of minors.
When using the App, You agree to comply with the following obligations to ensure a safe, respectful, and positive experience for all Users, and to protect the privacy and rights of others:
The Company is committed to protecting Your privacy as a top priority, and all privacy commitments outlined in the Pictal Privacy Policy are incorporated herein by reference. We strictly do not collect any facial information, biometric data, or any other form of personally identifiable information from Your uploaded photos, camera usage, or device. We use only Pictal’s self-developed AI services and never use any third-party services for data processing. We never send Your data, photos, generated images, captions, Records, or any information about Your use of the App to any third-party services .
All data processing is completed locally on Your device. Your uploaded photos, generated images, edited captions, and published Records are never collected, stored, or used by the Company for any purpose other than providing the photo creation and caption writing service. You have full, exclusive control over all content You upload or generate, and You can delete such content at any time directly from the App. The Company does not track Your usage habits, record Your browsing history within the App, or collect any device information (such as device model, IP address, operating system, or location) that could identify You individually. The App only requests necessary permissions (camera and photo library) when required for core features, and You may revoke these permissions at any time through Your device’s settings.
All intellectual property rights in the App, including but not limited to the self-developed AI technology, software code, design, logo, text, graphics, user interface, and all other content provided through the App, are owned exclusively by the Company. You shall not copy, modify, distribute, sell, lease, or otherwise exploit any of the Company’s intellectual property rights without the Company’s prior written permission. Any unauthorized use of the Company’s intellectual property rights constitutes a violation of this Agreement and may result in the Company taking action to protect its rights. Your use of the App grants You a limited, non-transferable, non-exclusive license to use the App’s features for personal, non-commercial purposes only.
You shall not engage in any activity that could damage, disable, overburden, or impair the App or interfere with any other User’s use of the App. This includes, but is not limited to, using viruses, malware, or other harmful software, attempting to gain unauthorized access to the App’s systems or data, or engaging in any conduct that disrupts the App’s functionality. The Company reserves the right to take action against any User who engages in such unauthorized use , including restricting or terminating access to the App, without prior notice.
The Company reserves the right to terminate or suspend Your access to the App at any time, without prior notice, if You violate any term of this Agreement, fail to meet the age requirement, or engage in any unauthorized or harmful use of the App. Termination may also occur if You engage in fraudulent activity, violate applicable laws, or fail to comply with the App’s content guidelines. You may terminate this Agreement at any time by uninstalling the App from Your device. Upon termination, all rights granted to You under this Agreement shall cease, and You shall no longer use the App or any of its features. Termination of this Agreement shall not relieve You of any liability arising from Your improper use of the App prior to termination.
The App is provided “as is” without any warranties, express or implied. The Company does not warrant that the App will be error-free, uninterrupted, or free of defects, or that the generated images, captions, or other content will meet Your expectations. The Company shall not be liable for any direct, indirect, incidental, consequential, or special damages arising from Your use of the App , including but not limited to damages resulting from content uploads, generated images, caption suggestions, in-app purchases, or any unauthorized use of the App. You agree that You use the App at Your own risk. The Company does not guarantee the accuracy, quality, or suitability of any content generated through the App, and You are solely responsible for any use or sharing of such content.
The Company reserves the right to modify this Agreement at any time, with prior notice to You. Such notice may be provided through the App, via email (if You choose to provide one), or through other reasonable means. Your continued use of the App after the effective date of any modifications shall constitute Your acceptance of the modified Agreement. If You do not agree to the modified terms, You must stop using the App and uninstall it from Your device.
